March 26, 2012: Board of Health Meeting

The Board of Health meeting called to order at 9:15 p.m.  The Pledge to the Flag was led earlier in the evening by Commissioner, David Butler.

Present:  Commissioner Dave Butler, Commissioner Delos Field, Commissioner Kenneth Hotaling, and Commissioner Julianne Sharratt.

Also present: Administrative Assistant, Tavis Austin; Attorney, Lynn Green; Water Superintendent, Grant Ward; Town Assessor, Matthew Lippitt; and members of the community.

Absent:  Commissioner Briggs Jones

Unfinished Business

Open septic at 3011 County Highway 11. 

  • The Town received an estimate totaling $16,370.00 from JB Line Cleaning and Plumbing for septic repairs at 3011 County Highway 11, Hartwick, NY 13348
  • Commissioners discussed Town funded abatement with collection for repairs to be billed through Otsego County Treasurer's Office - taxes and the process of abatement through Condemnation - Otsego County Codes.  The Commissioners also discussed contacting the Department of Environmental Conservation for guidance on enforcing abatement of open septic leaks near fresh running water.

All Commissioners were not in favor of the Town paying the expense of the abatement at this time, and agreed upon the following:

MOTION:  Commissioner Butler moved to:

  1. Notify the homeowner at 3011 County Highway 11, Hartwick, NY 13348 of the necessity to abate the open septic problem on the premises with in 14 days, or
  2. Commencement will be made toward the condemnation through Otsego County Codes, and
  3. Tavis Austin is to contact the Department of Environmental Conservation for guidance on enforcement of abatement of open septic near fresh running water.
  4. Tavis Austin is to draft the abatement letter to 3011 County Highway 11.

Commissioner Hotaling seconded, and the motion passed with the following votes:  Commissioner Butler "aye", Commissioner Hotaling "aye", Commissioner Field "aye", and Commissioner Sharratt "aye".

MOTION:  Councilman Field moved to adjourn the Board of Health Meeting at 9:45 p.m. Councilman Hotaling seconded, and the motion passed with the following votes:  Commissioner Butler "aye", Commissioner Field "aye", Commissioner Hotaling "aye", and Commissioner Sharratt "aye".
