Meeting Minutes

January 6, 2009

 

 

Meeting Called to order at 7 p.m.

 

Attendance: F. Thering, A. Thomas, T. Schlezier and G. Horth

 

Public in attendance: Anita Briggs and Henry Whipple

 

Minutes of last meeting: No minutes of last meeting were available to review. Tabled, until such time as Town of Hartwick hires a Planning Board Secretary.

 

Correspondence: There being none.

 

Public Comment: There being none.

 

Organizational issues:

Alex made a motion to appoint Gregory Horth as Chair for this meeting, until a chair is appointed at the Town Board meeting January 12, 2009. Greg will also act as secretary for this meeting.

Tony seconded. Vote: all ayes. Motion carried.  

 

Recommendation of Planning Board Members to Town Board:

 

Whereas; Article IV: VACANCIES, Section 4.2 of the bylaws of The Hartwick Planning Board does allow to Board to make official recommendations to The Hartwick Town Board.

 

By a motion of Ferd, The Hartwick Planning Board therefore makes the following recommendations to the Hartwick Town Board.

 

Anita Briggs

Jeff O'Handley

Vincent Rozella

 

Tony seconded. Vote: All ayes 4

 

A letter will be sent to Town Board listing The Planning Board's recommendations.

 

Alternate Planning Board Member bylaws:

 

Whereas, The Hartwick Town Board has created the position of "Alternate Planning Board Member". The Planning Board has no By-laws in regard to this position, In accordance with Article VII of our By-laws; the following additions to said By-laws are proposed.

 

Article III

Sect.3.3 - Alternate Planning Board Member's Vote Authority

 

Alternate Planning Board Members shall have no right to vote except in the event there is an absence of a sitting Planning Board Member, said member will be replaced by an

 

"Alternate Planning Board Member". The Alternate Member, so engaged, shall be entitled to all rights and privileges of that sitting member in their absence, and shall verbally cast one vote.

 

Article IV

Sect. 4.3 - Replacement of Planning Board Members by Alternate Planning Board   

                  Members

 

 When a sitting Planning Board Member is unable to attend a Planning Board Meeting an Alternate Planning Board Member will be appointed by the Chairman to take the absent Planning Board Members position at the Planning Board for that meeting.

 

Sect. 4.4 - Order of appointment of Alternate Planning Board Members

 

If ten (10) days or more prior notice of a Planning Board absence is known, or more than one Alternate Board Member is in attendance at a Planning Board Meeting when a vacancy occurs, vacancies will be filled by Alternate Planning Board Members on a rotating basis. If the Alternate Member is not available or unreachable for their turn, their turn is forfeit.

 

 

Sect. 4.5 - Replacement of Sitting Board Member

 

In the event a sitting Planning Board Position becomes vacant an Alternate Planning Board Member will be appointed by the Chairperson to fill the position for the remainder of the former sitting member's term. The Chairperson shall make such appointment based on the Alternate Planning Board Member who has the oldest date of appointment. In the event appointment dates are the same, a coin toss will determine who is appointed.

 

Tony made a motion to accept the bylaws as written and waive the 5 day notice. Alex seconded. Vote: all ayes 4. Motion carried.

A public hearing will be scheduled a next Planning Board Meeting.

 

 

Development Projects:

 

Cooperstown Agway's move to Hartwick was discussed. The Cooperstown Crier Article was passed to Board Members to review. It was decided that the Chair will draft a letter to Owners Matt and Julie Barns inviting them to our next meeting to determine sight plan requirements for their new location.

 

 

HELDERBERG 9 LOT MAJOR SUBDIVISION -

"HAWTHORNE HILL SUBDIVISION"

 

An informal informational discussion was conducted between Henry Whipple of Helderberg Realty LLC and the Planning Board as to requirements of the subdivision law and requirements for a complete application for his project. Mr. Whipple submitted a sample application and survey map for the board's perusal. Required town fees were discussed and a copy of the deed restriction removal (Libber 1050 Page 244) was provided to the board. Mr. Whipple plans to submit a completed application and long form SEQR in time for the next Planning Board meeting in February.

 

Mr. Whipple was provided with an outline of areas of the Major Subdivision Law, that  he should review.

 

Ferd would like a restriction on the Subdivision as "residential use only" when the time is appropriate time.
