February 2, 2009 Meeting Minutes
Call to order 7 p.m. Pledge of Allegiance
Attendance:
Board Members: G. Horth, F. Thering, T. Schlesier, V. Rozella, A. Thomas, A. Briggs.
Alt. PB Members: A. Hasak, S. Bush (also acting as secretary)
Others: J. Althiser, O. Higgins, D. Field, H. Whipple, M. Barns, J. Barns.
Minutes of Last Meeting:
T. Schlesier made a motion to approve the minutes as written. F. Thering seconded and A. Briggs abstained. Motion carried.
Correspondence:
Letter received from DEC regarding the Niedzialkowski project.
Letter received from the County regarding training available for the planning board.
Public Comment: There being none.
A Public Hearing is to be scheduled at the next Planning Board Meeting to discuss the New Alternate PB Members By-laws approved last month.
Enforcement Officer Report: Town Board has not advertised for the vacant position of Enforcement Officer. Put on the agenda for the next Planning Board Meeting.
Development Projects:
Jurisdictional Determination:
Agway's store owners Matt and Julie Barns discussed the move to the Wildwood site location, which they own, and is an active business with an approved site plan. As of right now, they are not changing their current site plan or sign. They would like to come back in the future to discuss changes to the driveway. They provided the PB with a sketch plan of changes they would like to make in the distant future for their perusal. They will submit a site plan change application at that time. A. Thomas made a motion that given there is no changes to the site plan that the Planning Board does not require review at this time, but if changes are to be made to the site plan - parking, lighting, etc. then Matt and Julie Barns would have to come back at that time. V. Rozella seconded. Vote: all ayes (6). Motion carried.
Matt and Julie Barnes to be put on the agenda for the next Planning Board Meeting.
Real Property Changes:
Delos Field came in for a determination in request to a boundary line adjustment on his property. After review by the Planning Board, V. Rosella made a motion to that the real property change was a boundary line adjustment and exempt from review or application. A. Thomas seconded. Vote: all ayes (6). Motion Carried.
Helderberg Realty - Henry Whipple provided the board with an application, SEQR long form, "preliminary plat" Survey Map, and additional application materials, for a 9 lot major subdivision. The Town Clerk provided proof that his fees to the Town of Hartwick were paid.
WHEREAS: an application has been submitted for a Major Subdivision Review, County of Otsego Tax Map # 194.00-1-4.00, by HELDERBERG REALTY LLC, HENRY WHIPPLE, BROKER, 325 Old Stage Road, Altamont, New York 12009, Applicant for HELDERBERG REALTY LLC , Owner. Applicant is seeking approval to subdivide a 66.873 acre parcel into nine (9) parcels. The parcel is located at, the corner or State Highway 205 and County Highway 45, in the Town of Hartwick. After the Planning Board reviewed the application; V. Rozella made a motion to accept the application as completed. F. Thering seconded. Vote: all ayes (6). Motion carried.
WHEREAS: the proposed subdivision is an Unlisted Action according to the State Environmental Quality Review Act, and a Long form Environmental Assessment Form has been completed at the Planning Boards Request for their review, and
WHEREAS: this Board, acting as Lead Agency in environmental review, has reviewed and accepted
The Hawthorne Hill Subdivision application as Complete along with a "preliminary plat" Survey Map entitled "Hawthorne Hill Subdivision" prepared by William J. Symolon, Jr., Licensed Land Surveyor, dated 12/31/2008, and additional application materials, and
WHEREAS: pursuant to §239 -l and -m or -n of the New York State General Municipal Law, this action
does require review by the Otsego County Department of Planning, now therefore be it
RESOLVED:, pursuant to, and in accordance with, the provision of Section 617.6 (Initial
Review of Actions and Establishing Lead Agency) of the New York State Environmental Quality Review Regulations (6 NYCRR part 617) the Planning Board of the Town of Hartwick seeks Lead agency, by this Resolution dated, February 2, 2009, for purposes of SEQRA and will conducted an uncoordinated review and proceeded as if it were the only involved agency.
A. Thomas made a motion that to approve the resolution for The Hartwick Planning Board to be lead agency and prepare and send out letters to agencies notifying them of such. F. Thering seconded. Vote: all ayes (6). Motion carried.
Helderberg Realty to be put on the agenda for the next Planning Board Meeting. A initial Public Hearing will be conducted if proper notification time is possible. SEQR long form is expected to be reviewed by the PB.
Public Comment:
O. Higgins would like to see the Planning Board limit the subdivision to cluster housing. A. Hasak stated that the Planning Board should just follow the laws.
H. Whipple stated the 9 lot subdivision was best for this kind of property.
Regulation Revision Work:
G. Horth introduced a noise ordinance law and asked the Planning Board to look it over and discuss it at the next meeting.
V. Rozella made a motion to adjourn. F. Thering seconded.
