Of The August 4, 2010: Regular Meeting of

Town of Hartwick Planning Board

Call to order 7 p.m.

Pledge of Allegiance

Attendance:

Board Members: G. Horth; A. Thomas; V. Rozella; Sue Bush; T. Schleiser; F. Thering (absent); A. Briggs (absent)

Alternate PB Member(s):  Glenn Schilling (seated); Margaret Kennedy (seated)

Public: D. Petri; Tavis Austin

Minutes of Last Meeting: 

A. Thomas, made a motion to approve the July 6, 2010 minutes as submitted.  T. Schleiser, seconded.  Vote:  All Ayes (7, 0, 0).  Motion carried.

Public Hearing(s):  None.

Regular Agenda:

Signs:

•1.   "Tops" Owner/Applicant: Kassis Signs Location: 5 Commons Drive, Hartwick NY. Project: New wall, freestanding, and directional signs (reface of P&C Signs with Tops)

A. Thomas made a motion to approve the application as submitted.  The motion was seconded by V. Rozella and the vote had the following results (7, 0, 0); Motion Carried.

•2.   "Golf Shop"  Owner/Applicant: John Miller Location: 4969 ST HWY 28, Cooperstown, NY 13326 Project: 2, seasonal (Memorial Day through Labor Day) freestanding signs

V.Rozella made a motion to approve the application as submitted provided that the signs not be placed on any paved portion of the roadway.  The motion was seconded by T. Schleiser and the vote had the following results (7, 0, 0); Motion Carried.

•3.   "DiMaggio's" Owner/Applicant: Richard DiMaggio/Jeff Salinger Location:  vacant land across from the Commons Project: One seasonal sign, off-site

G. Schilling made a motion to approve the application as submitted.  The motion was seconded by M. Kennedy and the vote had the following results (7, 0, 0); Motion Carried.

•4.   "Grand Slam Paintball" Owner/Applicant: Paul Ingalls, Jeff Salinger/Michael Grampp  Location: Behind the Commons, Tax Map No.: 162.00-1-50.01  Project:  Three (3) seasonal signs, each 2x3 (6 sqft).

M. Kennedy made a motion to approve the application as submitted provided that between Labor Day and October 31, the signs would only be displayed when the business was open (i.e. weekends as specified on the application).  The motion was seconded by S. Bush and the vote had the following results (7, 0, 0); Motion Carried.

•5.   "Pizza Hut"  Owner/Applicant: Pizza Hut Location: 23 Commons Drive, Cooperstown, NY 13326. Project: 2, 2.5x2 (5 sqft) seasonal signs in front of building (along ST HWY 28)

A. Thomas made a motion to approve the application as submitted.  The motion was seconded by V. Rozella and the vote had the following results (7, 0, 0); Motion Carried.

Projects:  None submitted.

Public Comment:  None.

Planning Board Business: 

T. Austin, Local Laws Enforcement, discussed the process of personally notifying the ST HWY 28 business owners of the Sign Law and the permitting process required.  He stated that all businesses were contacted; many, as seen on the agenda, chose to apply.  Three business owners did not apply and were, as such, still in violation. 

The Planning Board felt it appropriate to initiate formal enforcement action on those owners that did not comply with T. Austin's verbal request.

V. Rozella made a motion to adjourn the meeting.  The motion was seconded by T. Schleiser.  The motion carried by unanimous vote and the meeting adjourned at 8:30 PM.
